What Happened To Parole In Place: Stay Extended

Author: Alena Shautsova

On September 4th 2024 a federal judge ordered another stay of parole in place relief for families of the US citizens. According to this new order the stay will be in place until September 23rd 2024. Because of this stay new applications that are filed with USCIS cannot be granted.

However US CIS can still accept new applications and can administrate collection of the biometrics in relation to the parole in place form I131F applications.

Those applications that had been already granted I'm not affected by the stay.

Remember that alternatives to parole in place remain I601A waiver and cancellation of removal.

The qualifications for parole in place are different than those for I 601A or cancellation or removal, however, they are related. The main difference is the strict requirement of physical presence from June 2014 to present, that is a must requirement for the parole in place relief. At the same time, extreme hardship is not required for the parole in place to be granted, but is required for I 601A or cancellation or removal.
