Parole In Place For Military Families |

On November 15, 2013, USCIS issued an official Memorandum clarifying the procedures for parole in place: a relief available for EWI (entrant without inspection) immediate relatives of the Military personnel. This relief is not a new law. In fact, it has been used by Immigration practitioners for a while, but the new Memo expanded its reach by adding members of veterans to those eligible for the parole in place and by specifying the guidelines that USCIS officers should follow while considering the applications.

Parents of those US citizens who are over the age of 21 qualify to be what the USCIS considers an "immediate relative". Immediate relatives do not have to wait in line for visas because there is no cap for this particular category of an immigrant visa. Sponsoring parents for green card is a simple process of filing an I-130 on behalf of each of your parent individually. Afterwards, parents will have to file an I-485 Adjustment of Status or Application to Register Permanent Residence.

Filling out the form for an I-130 can be simple, fill in the blanks with the appropriate information and your done right? Not quite, a major mistake people make is differentiating between petitioner and applicant. The Petitioner will be the US Citizen or Lawful Permanent Resident; the Applicant will be the family member seeking lawful US status. First and most importantly, a check made payable to USCIS for $420 must be attached with the form.

Tips On How To Get A Successful I-485 Adjustment Of Status

An I-485 form is used to register for, or adjust to permanent residence status. This form is one of the most expensive to file with the government (currently it is $1070). It is important to verify your eligibility for adjustment of status before submitting it to USCIS because once you file, if you are denied you will have to file again, if eligible, and pay the filing fee again.
