ASYLUM PROCEDURE

After an applicant has prepared his /her application form I-589; his/her affidavit (declaration) (See PART II); and supporting documents along with an English translation of such, an applicant need to properly assemble the package and file it.

When submitting an Asylum application with the USCIS, a person must provide an original and one copy of the application and three sets of the supporting documents. According to the instructions to the form I-589, a person must attach ONE ADDITIONAL copy of the complete application and additional proof of his/her relationship for EACH family member included in the application.

Also, an applicant likewise required to submit a passport style photo of himself/herself and for each family member applying with the main applicant; plus three copies of documents regarding identity of the persons applying for asylum (copies of passports (COVER TO COVER); birth certificates; military ID, etc).

IMPORTANT: there is NO FEE for flying of Asylum application.

All the documents must be submitted in required by the USCIS order and should be organized and secured so that they are easily separated. The passport style photos should be stapled to the application, and, I advise, on the back of them, with a pencil, to write person’s first and last name, and an A number, if any.

Can one amend an asylum application after it was filed?

Yes, an applicant may amend the application on the day of the interview. It is very likely the applicant will be questioned about the reason for the changes. A second chance to amend the application will be when (and if) the case is transferred to an Immigration court.
